I am asking this for a friend of mine that lives in KS. (She doesnt have a computer, He got it in the divorce)
She has two children 5 and 7 and He (her ex) has been ordered to pay child support and has NOT paid one cent. What are Her rights? Her lawyer doesnt seem to be helping Her at all. Does She have to let him see the children?

Your friend needs to file a petition for contempt asking the court to order payment of back child support.

If the child support order came as part of a divorce decree, the contempt petition needs to reference the child support order.

On the other hand, if your friend went to a Child Support office and obtained an order for both children - the child support office has to file the petition for contempt.

If visitation was included in the divorce decree - yes, she must allow him to see the children. She ought not engage in Parental Ailenation Syndrome by telling them their father is no good, etc.

I don't know what the laws are down there!

However, I do know people around my own area that pay child support and as long as they pay the support they get visitation rights. If they have a violent side to them they may be lucky to get supervised visits.

So your friend should let the father see the kids if isn't violent!! and or if she can prove it is in the best interest that he don't have contact with the kids do to mental abuse or other little things she can fight it in court and ask that his visitation rights be taken away.

but since she hasn't recieved any of that money she can try going to social services and get him that way.

What's wrong with her lawyer??? If the man works they can take the money directly out of his check. Not letting him see the kids only hurts the kids. That is a terrible way to play one another. Let him see the kids for the kids sake. And deal with the lawyer for the support.

get in contact with health and human services for the state in which she lives. they will have a child support enforcement agency which can attach his pay, also he could lose his drivers license hunting license passport etc. also do jail time if he doesn't pay up. the state can also attach his federal income tax if he does not pay child support. she should let him see the children, the kids suffer enough with having to do without. don't make them suffer by not seeing their dad.

If she doesn't let him see the children, she is guilty of interfering with the court order. If her lawyer won't help her, tell her to try social services.

Each state has different guidelines. She's best to check with child services in the county she resides in to see what the guidelines are. I would doubt she would withhold visitation. Fire the attorney and find a new one.
