My personal opinion says no not appropriate, but as long as her ex doesnt have a problem with it I would say go for it. If he doesn't approve to me that would be disrespect.

Your friend's brother-in-law" is still concidered family. I can only assume they've been sneaking around seeing each other,while she was still married to his brother. This is "Bad Taste",and certainly poor judgement. The both of them should be ashamed of themselves! (Blah!).
