i would go with a lawyer because if the granmother has had poblems with drug and the police comes in or something child services can be a pain and maibe tri to keep him a way from u and the mom and tri to get costedi for ur self make her pay child suport not u

If a parent is not fit, the other parent does have right for full custody. YOU HAVE TO DO IT THROUGH the legal system though or you will not succeed! If the child is in danger, file an emergency petition with the court. Even if you just think he is in danger, you can do this. Go to the law library in your county or the local Family Court and ask them for the papers. You DO NOT need an attorney, but if she puts up a battle, then you should. Once a petition is filed, you will have time to explain to the courts your side. If she has custody and gives the child to the grandmother, this is not right because the grandmother or anyone does not have custody. DO NOT HESITATE to take action if the child is in danger or possible danger, the court house will help you, so contact them right away.

You have the right to make sure that your son is in a safe environment. Until the mom becomes stable, you have a legal right by having joint custody to get him and make sure that he's cared for properly.
Handle the situation carefully. Explain to the g-ma that you want him to stay with you for a while. If she consents, then take him... if not, then let your lawyer know that she has said no and inform them of the situation. They'll advise you on the most legal way to handle it and be able to keep your boy.

You have every right... and you should... file for custody of your son. You have the ability to prove that your child is not in an appropriate situation and any judge should grant you custody if you can sufficiantly prove your case. Get a lawyer to help you with the paper work and legalities.

You can only have your child based on what the current custody papers say. Otherwise, during the time the mother has him, she is allowed to leave him with another caretaker. You'll need to change the custody papers, I'm sorry to say. You have a battle ahead of you. Good luck.

"joint custody" means just that..you have rights all well as she. do you guys have a parenting plan? no matter what, all decisions should be designed to benefit your son

It sounds like you could get custody as long as you probably did not do no longer some thing to damage the youngster. i will't even imagine leaving my daughter with my mom merely to be with some guy.
