The kid's in early teens. The dad just got custody of the son.
The problem is, dad refuses to speak the the Mom for any reason.
She leaves messages about dental & dr. appts. but he ignores them. The kid has no supervision from 8pm-12am-dad works nights. He's now smoking and cursing just like dad. Last visit Mom found 2 unused condoms in his bag & when he left he hadn't used the toothbrush or toothpaste she put in his bathroom. How can the Mom care for her son? Will she have to go back to court? Can that be considered Neglect? Is the kids age a factor?

He got custody because the boy is a teen and got mad for getting yelled at for not cleaning his room. He cried to daddy, he got lawyer & the judges here listen to kid's wishes & NOTHING else.
Even with proof of years of domestic violence

I think it would be considered neglect in most states but a few really don't care about kids after they are 12

I dont know the answer to this but i have a question, how did mom loose custody to this child. The dad seems like a real dip stick. So in the courts eyes the mom must be alot worse. She should have taken care of thing when she had custody. And if she has ability to see what in the childs bathroom then why doesnt she talk to the dad when she is there.... there are too many question for a decent answer

unless the medical is emergency, there is most nothing that can be done beside filing neglect charges, and depending if the dad is supplying the smokes possibly contributing to the delinquency of a minor, i fear the real issue here though is if the boy doesn't listen to his mother, doing these things may draw them further apart. and may bring the father son closer too unite against the mother the mother needs too weigh which issue os greater and be prepared for any consequences. about the toothpaste.... maybe the teen brought some with him?

Why does the father have custody? From what you write it sounds like the mother is a better parent. Get a lawyer and go back to court.

well legally the father cant neglect the the sons issues and stop the mother from taking care of his son she can take him to court for neglecting needs and even maybe get custody of the child if prove that the father is not able of taking care of the kid

The kids age is definitely a factor. If he's under say 16 it may be illegal to leave him alone at night. Contact the local Department of Social Services and see what they recommend. If they think the child is in danger they can remove him from the home.

I'd say the mother should definitely get an attorney and have the custody issue reviewed by the Court.

i think the father is being irresponsible and the mother has the right to do whatever she thinks is in the best interests for the child even if the father is the legal custodian.i just hope the kid isn't emotionally scarred by this stupid infighting.

Hmm I'm not sure I am no good at custody problems, but she would probably have to go back to court.... My guess! Good luck for whoever that is...
