Are these two one in the same. I assume that domestic partner originated from gay and lesbian relationships, but it is also used as different sex relationships, does that mean a state must have common law marriages in order for domestic partner coverage on insurance plolicies to work?

Domestic Partner is an insurance benificiary that's not related to you. This doesn't have to be someone that you're romantic with. Common Law Marriage is someone who the State defines as your spouse by virtue of you sharing residence for an extended period of time. This also doesn't have to be someone you're romantic with.
