and you were smokin it,but 5 minutes before a stranger had walked up behind you and said smoke this and i wont shoot you in the back and dont turn around, then quietly disappeared without your knowledge,how could you prove you were a victim and you were not breaking the law ?

You have to convince the cop that whatever you are telling is correct. You have to produce cogent evidences or witnesses in support of your argument, which will be difficult for you. This is not a serious crime so just pay the fine a get over it.
