The landlords want me to pay for the house until they rent it to someone else! They haven't even posted a for rent sign yet and it has been 10 days. It really doesn't say either way in the rental agreement what happens if we don't give full 30 days notice to move out.

On a month to month, you would owe for the month. So, you would owe for 10 days but not until they re-rent it because you were month to month. Stick to your guns. Worst case, you owe the 10 days, not the rest.

You are responsible for that next month since you didn't give the 30 day notice but NOTHING after that. It sounds like your landlord is trying to screw you and that is not good. Let him try and take you to court and see what happens. He is stupid if he thinks he will get away with it.

Now I just thought that maybe he says he wants you to pay a prorated rate until someone rents it if they rent it within the month you are being asked to pay for??? If so then he may have been trying to help you out with what you would owe after you were already moved out... I am not really sure.

Logically if you give notice (which you say should be 30 days) but move out after 20 days, you should only be liable until the 30th day. You "pay off" your 30 days even though you only stay for 20. Anything after that is your landlords responsibility.

If you are renting month to month, I think the only way you are obligated to pay is the full month, instead of 20 days. I also do not think you will have to pay the landlords until they find someone to occupy your apt. This can take awhile and it is not your responsibility, its theirs.A month to month lease is different from a year lease. Lots of luck!!

If the lease says 30 days, then you may be liable for a single extra months rent, but he cannot force you to keep paying rent until he rents it to someone else.

Usually a tenant gives a 30 day notice before a tenant vacates. I think that is normal... But make sure its ok with your landlord because you don't want him coming after you later with a huge inflated bill. Leave it clean and take pictures to protect yourself if needed down the road.

some may charge your prorated rent thats rent you pay for only the time your there . he cant charge you after you vacated . if they try sue there butts off . good luck
