Can the builder request money from lighting overatures (900.00) and a sidewalk (1,294.00) from the construction of our new home 10 1/2 months after settlement/closing which was done at our lawyers office? These two items where not identified during closing. It's just sloppy book keeping on his part. How does my contract with him from construction proir to closing hold up for him or even me in this situation? Whats to say he may find something else at a later date that he or even us are not aware of and want the money for that too.? Looking for help in Richmond Va.

A settlement and closing is just that...you settled on the amount of the purchase and closed the deal. He might even threaten to take you to court, so let him. He doesn't have a leg to stand on.

Ps. Oh yea, I found some old receipts for your kitchen cabinets, your plumbing, your electrical work, and your new carpeting...tell him to go fly a kite.

Despite the sloppy bookkeeping, you owe the money if you requested that the work be done. However, you or your attorney should carefully review the contract to make sure that this request for additional payment isn't something that was included in the original contract price. Sometimes contractors will miss something on a bid and then try to slip it in on a change order.

go back to your lawyer and go thru the paperwork with a fine tooth comb.a time limit is set for the contractor to bill for services just as you have for material and workmanship warranty. check to see if the work was performed by the builder or a sub contractor? did the builder have the responsibility to pay the sub??? check all of this. the person or company who performed the work can file a lien on the property in question.

Contact the atty/closing company that did the closing and see if your title policy will cover it as a claim (Probably not) or if you are liable at all.
