it's only illegal if they get caught

It is a major illegal no no. You can not legally record a conversation without the consent of at least one person in the conversation... i.e. you can record your conversation with someone because you agree to it... but if niether party are aware of it at the time you could get in major trouble... sorry for the let down.

It doesn't matter if it's a terrace house or an apartment or regular house. If they are on their own property I believe they can.

What goes on in someone else's house is their own business... unless you think someone is in danger in which case you should alert the authorities
