parents faked the date of marriage on child's birth certificate for they want their child to bear her father's name,under philippine family code,does she has the right to use her father's surname?can she obtain a passport if she wants to travel abroad,by the way,the child is still minor

In most countries today, a child may be given and may use the last name of the father, the name of the mother, or a combination of the two.

If the name used differs from the name on the birth certificate, it may be necessary to change it formally. In England by deed poll; elsewhere by court order that would require consent of both parents so long as she is a minor.

I don't know anything about Phillipine Law, but in my country, yes of course. Parents being married or not is not an issue here, but they must be able to legally cahnge the child's name by Deed Poll using the court system. But by the sound of it the child already has the father's name on the certificate. My Daughter has both Parent's names one after the other, in Hispanic style, but she usually uses my name (her Dad's) for all her dealings, only adding the other one for passport and legal dealings. She's still a minor too, but she says she wants to drop her mother's name legally when she's older, but it's her choice.

Whatever the name was that was given to the child at birth is the legal name and must be used for legal purposes, but they can use their fathers name in everyday life. My children went under my maiden name for years before going back to their given name when they were older.

Of course. You may name your child anything you like. It is most common to use the father's last name, but not legally required. Furthermore, it is possible to change the child's name by going to court.

Ah yip! I don't know how it works in the Philippines. In the US you can call yourself whatever you want as long as there is no intention to defraud.
