Firstly decide who to sue? The advertiser or the webmaster or anybody else, or all of them. Decide whether you want to sue the people individually or just the company or both. Generally, suing in small claims means you are confined to people who live in (or are physically present in) your state and companies that have a presence or do substantial business in your state. Suing a sleezy website might be a waste of time.

Call the webmaster of that website. Tell them about your other victories in small claims or district court (if you have any, this always helps). Don't just sue just for the heck of it. Because Law expects every individual to come to court only after exhausting all other remedies.

If the is website's office is located in your state, you can sue them in small claims court or the district court. But if it is located outside of your state then you have to file your case in that state.

You need to find an attorney who is located in the state where that company is incorporated, or where the company regularly does business. The attorney will be able to analyze whether you have a case, and guide you through the steps involved.

I hope you have plenty of money, because lawsuits are expensive to institute.
