If I want to create art and use something created by others to make my art, how do I get the rights to use those materials? For example, if I want to use photographs taken by others, how can I get the right to use those photo so make my art and sell it?

You'll have to contact the person who created the photo and arrange for a license to use their copyrighted material. They may want a percentage of what you make, or they may charge a flat fee. In either case, it's best to reduce the agreement to writing, that way you'll avoid any possible lawsuits in the future if they claim you've infringed on their copyright.

Hi

The first rule of thumb is to get permission / consent. If you don't have that, if you take an original and substantially alter it adding creative value to it, you can get a copyright in the new creation.

But, be careful. Safest route is to get consent.

Once you create anything, you as a matter of law, get a copyright interest in your creation; however, if you want to enforce that right, you generally have to file the creation with the U.S. Copyright Office. By filing, you get the right to sue in federal court for enforcement and damages. If you don't file, you can't sue in federal court to enforce your rights, but you may still have state law rights which you can enforce.

Hope that helps......

Bestguess is again correct. You need to contact the copyright holder, and arrange a license (permission) to use their materials.
