We had to make a down payment--which the car dealer broke down into smaller payments for us. They are now telling us we do not get a title or plates until the entire down payment is made. This info was not revealed until last week. We have yet to make our first actual car payment. Can we legally return the car and get our vehicle back that we traded in( which is still in our names with no insurance)?

My advice is to speak to a lawyer and the best, most inexpensive way to do this is through Pre-Paid Legal Services. Plates can sometimes take until after temporary plates expire. Title is not given to the "owner" until the vehicle is paid for. If you have not fully paid the vehicle off, the title does not yet belong to you (and, technically, neither does the vehicle). Now, if you signed a contract, and your contract terms are different than the terms you are experiencing, you may be able to get your money back (breech of contract). If it had been less than 30 days, and your state has a "no lemon law", you could have probably returned the vehicle for your money back, minus any non-returnable fees.

But, if your biggest issue now is that you have no plates, and you have not paid the full down payment, you have not fulfilled your contractual obligations, if the contract you signed included a fixed down payment. In that case, you should pay the dealership what you agreed to.
