I nail the neighbors dog about two or three times a week with either a b b gun or the pellet pistol. He gets home in a hurry when he seems me coming. Could use a sling shot too.
Another thing I have found effective, and a bit more passive, is to use rose bush trimmings. If the cat has decided just one area of your yard is his bathroom spread some rose bush clippings, or other plant that has stickers on it, in that area.
I save the branches when I trim rose bushes and cut them into two to three inch pieces. When I have a need for them as a deterrant, spread some out in the area.
I have also heard of folks using pepper products. Cayenne pepper etc. When the critter comes through and is using his nose to find his way around, the pepper gets into his nostrils and soon convinces him to look elsewhere.

I've never heard of a cat pooping on a lawn. They like to dig and then cover their poop. Dogs like to poop on lawns so maybe its a dog doing it. Cats like soft soil or sand to poop on. Whatever reason you have for not killing it, I hope you stand by it because the bad luck could be from a neighbor calling the cops on you if you did and laws are getting strict on animal abuse.

Remove anything that could be used as a litter box, I.E., sand, mulch, piles of leaves. Remove anything that a cat may be attracted to, I.E., squirrels, mice, birds. Don't pull in front of the house and leave a vehicle with a warm engine in the winter. And, once you decide there is no way, either tell the owner to keep it indoors, or shoot it in the eye with a pellet gun. Recommend a Benjamin.

If you can discover the routes by which the cat enters your garden then I find sprinkling white pepper in the area will keep it away. Pepper makes cats sneeze!
