Wow, what a very good question. I purely found out that bush ought to be easily smarter than we expect of? By the Court case relating the the ON Box anything that isn't HARD wired can be tapped by anyone that makes their own equipment. Since most communications that go any distance at some point transverse free air space it can be legally tapped. I'm surprised anyone worried about their privacy uses a cell phone. Blame technology not big brother - privacy is an illusion.

WMcritt - Here is the complete 4th amendment, it seems you accidently left out the part about Warrants (court orders) and Probable Cause (a high probability that something illegal is going on). Note there are no sweeping powers allowed here to monitor groups of people - the court order must describe exactly what it is going after, and where the stuff is. Oh one last thing - the NSA monitors huge amounts of phone calls, emails, etc..... by listening to as many conversations as it can. I'd be willing to bet they are monitoring you. Take me up on it?
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

you clearly no nothing of legal precedent. During World War One EVERY telegram and cable message sent into or ou of the US was read by the gov't. In a court case that reached the Supreme Court over the matter the court upheld these actions taken during time of war. Also these similar measures happened during World War Two when FDR, uber_Democrat, was President. And again NO court ruled against this.

If your lines are tapped, I recommend you stop speaking to terrorists.
That "warrantless" surveillance has prevented several terrorist attacks (remember the attack that almost was, on the NY subway systems? The attacks on various buildings throughout the US? No? That's because they didn't happen. Why didn't they happen? Because those people were being WATCHED.). It would serve you well to remember that.
