My old phone is completey broken.My cell phone carrier is Cingular it sucks i don't have insurance for my old phone and they are asking big bucks for buying new plans and also asking me to signup 2 year agreement where they offer some discount

You can purchase a new cell phone anytime you want. Wal-Mart sells them all the time for a reasonable price. I use Cingular's KIC plan. I had to buy my cell phone for about $100 (Radio Shack) and pay about $15.00 a month for the KIC plan. That beats my old cell phone contract of around $41 a month. It's cheaper than a contract and I can always get a new cell phone just by putting my SIM card into the new cell phone. By the way, I'm not a big cell phone user, so if you talk a lot on the cell phone, the pay as you go plans might not be right for you.

As far as buying new phones under a contract, it is the SIM card inside the cell phone that activates the cell phone. You transfer your SIM card from your old broken cell phone into the new phone. With my LG phone, I pull off the battery, take out the small gold card, place it into the new phone, do a little programming, and I am good to go. Sounds like you might be getting bs'ed by a local provider, but I wasn't there when you had the conversation, so I don't know.

Being that you have Cingular, you can purchase an UNLOCKED GSM cellular phone from any of the online retailers that sell them. Aslong as the SIM card wasn't damaged you can just remove it from the old phone and place it in the new phone. No contracts required.
This one of the great features of GSM, your ability to purchase new phone without renewing your contract[s] whenever you want.
