My daughters father is paying child support and he is still filing her on his income tax every year. and i want to know if possible that i can get her social security number changed or what, so that he cant continue to file her for his benefit. I have contacted to IRS and they are saying that he cant because he needs to show prove of where she is staying and its against the law and he will get caught or auditted. Each year when i file her they always ask me to provide prove of where she is living. what can i do to prevent this from happening again?

All you need to provide the your address and a copy of the school records that show your daughters home address is your address. That is all you need to provide. The child's father is playing with fire. It's not nice to jerk with the IRS. He could get a tax bill he may not be too happy about.

I am 99% sure that the Social Security Administration will not change her ssn for the reason you are giving. all you can do is to continue reporting him, and continue to provide proof that the child is living with you. We can only hope that eventually the IRS will catch up with him.

Well, the bad news is that you can't change her social security number. But the good news is that you can change her name.
Now wouldn't it be an oddity that a father doesn't even know what his daughter's name is? I bet that would tip off the IRS.
It doesn't have to be a drastic change to be effective. You could change a name like Mary Elizabeth Smith to Elizabeth Mary Smith. She'll still go by the name of Mary - but when it comes to legal documents like a 1040, well, the legal name is what they want.

You can't change it, it identifies her for life. Let him, you have given the IRS a heads up. Believe me if he files her again then he will get in trouble this year.

Good Luck.... I've had my stuff stolen from my car with all my info on it, and I went to change my SSN and they just gave me some ways of how to see if someone is using my name and SSN. They won't change that for anything!

you need to file before he does, then they will ask him.
no you don't change social secuirty number but you can sue him in family court over this
