i've married my husband in april this year, we are desperate to split up but i've just read on some website that i can only legally apply for divorce after ONE YEAR! is this true? i want to ensure my property, if i die, goes to my sister, i have a prenuptial in place protecting my possessions and he has his own...i have an op next week and i'm thinking of this more than ever...i'm SO worried!

asmoothri - i'm a bit worried cause we've known for several weeks now that we CAN'T live together, he's got anger management issues...and i'm not exactly the docile type either, so, it turns out we bring out the worst in each other (sadly, we do care about each other though, in moments of calm we are able to rationalize and conclude this). we both feel we just want OUT rather than let this whole thing drag on. i am being probably paranoid around the op... and therefore i will renew my will... (i plan to leave him something but the majority for my sister)

You can't divorce until you've been married for a year, but you could file a petition for a judicial separation. The procedure is the same as a divorce & you'd have to go thru' it all over again in 7 months, thereby doubling the costs. Within the j.s. proceedings you could sort out your finances by lodging a consent order. Make a will now, and specify the reason for your not leaving anything to your husband.

Yes in the UK it is one year, why not just live separately until that time has past? You don't need to be living in the same house for a year. If someone has committed adultery then you can divorce after 1 year, or if the person has behaved unreasonably you must provide 5 examples of this. Other than that is is 2 years separation with consent (and you must live apart for at least 6 months before applying this way) or 5 years without consent.

If you are that worried about dieing why don't you go to a solicitor write a will and cut them out of any inheritance. Sorry to sound cold but it would stand up in court. On the divorce side a year isn't as long as you think, let face it you only have another 7 months to go now.

How sad. Think 1year. Try to contact citizens advice and have it all in place as i think you can have it void if its under that time But at least you where both sensible to have prenuptial agreement drawn up so this makes it a lot easy. Try not to stress to much as the important thing is to get better. after your op .. ..

the only thing i know is that if you try to get divorced before the two year period of separation they like you to appoint blame, mud sling. so i waited till after the two year separation....
