My parents are getting divorced...my dad already introduced the paper for the divorce, my concern is that my mom is very sick, she cant work, sometimes she can even stand up for herself, he says that he is going to help her with her expences, i cant help her because what i earn is just for my school. do we have to get a lawyer to help us on that??, im sure he is just going to give her money for the first two months and thats it. they've been married for more than 25 years i dont know how that is in the state of florida. help???

I don't know what the laws are for your state, there's such thing as alimony if a spouse can't provide for him/herself, and the other person had been a primary provider. There's no harm in calling laywers around, the first phone consultation is usually free, and they can give you an idea as to what your options are. I certainly wouldn't count on good intentions alone, it all has to be stated in the divorce agreement.

You Mom needs to get a lawyer for sure. You never know when your Dad will stop being generous or what he's up to, plus, he could meet someone new & "forget" about your Mom & use his money for his new family. Your Mom needs financial security, she can't get it going through a divorce without a lawyer. Your Dad may also use the money issue as a means of being able to still control her. Maybe part of the divorce settlement could be your Dad helping to contribute to paying for her healthcare. Good luck & make sure you stay by your Mom's side, she'll need your help.

If they've been married for over 25 yrs, your mother is entitled to half of everything. Which means half of your father's pension, half the equity in the house, and stocks/bonds they own, etc. You may have to find these things for her. If she's not working, she should ask for maintenance (alimony), which will give her a monthly alotment every month until she remarries. Just make sure that everything is in writing. I know your father may have made that statement, but like you said, he'll probably do it for the first few months and then stop. If you don't want that to happen, help your mother and make sure everything she is going to need will be in the court papers.

If they're getting a divorce your mom needs a lawyer to protect her interests in court. Verbal agreements mean basically nothing.
Without your fathers income, you and your mother may be elible for some government programs that can help you financially as well as with utility bills, rent, etc. And if you are under 18, your father will have to pay child support.

Gab, I am truly sorry. Most states have a "Legal Aid" office that will help those who can not afford to pay. I do not know if Florida is a community property state, or not; but in these states, after ten years of marriage your mom would be entitled to one-half of all assets; home,money,etc. And also one-half of all retirement benefits of your father. If your Dad says that he is going to help her, he should be willing to put that in the divorce decree. Actually stating that he is willing to help out with xxx dollars each month for her expenses.
If he is not willing to put this in the decree then you are probably right in that he will only give for a couple of months and run.
Being the daughter, you should have some influence on your dad and let him know that you want your Dad to honor his words and help his mother, and make sure you hold him to his words!

I say you get a good lawyer and take everything you can girl....don't let him just walk easy and what is his reason for leaving??? There are grounds for a divorce ya know.

No if she is unable to work then the lawyer will make sure your father pays her even if they have to take out his check..... and besides if he left knowing she is unable to work and refuses to pay he is a real ********.. that is just wrong
