I have been working at a car dealership for nearly two years, and they said that they were now required to run background checks on everyone. I filled out the form and they sent it in. I ask them how far it went back. They told me it was only to check over the last year. It picked up a shoplifting citation I plead guilty to 4 1/2 years ago. If I had known this was going back that far or that they hadn't run one back that far, I would have explained what had happened before allowing them to send it.

I am very open about what I did and have never done anything like this before. I was in a terrible divorce when I committed this and plead guilty to a summary offense. The public defender told me this was no more than a citation and that it wouldn't affect in the future as far as employment was concerned.

I work for a background screening company. First its tough to prove what she said to you about how far back they were going to go. It's your word against theirs. The industry standard is to report 7 years unless its a felony, then there is no time limit. There are a lot of company now screening everyone who works for them even if you already work there. It is perfectly legal for them to do that as long as they apply the same standards for everyone.

If you're questioned about it, and since you are willing to be open and honest about your past than I wouldn't worry too much. I would be a bit concerned that they went as far back as they did after they stated they wouldn't...but sounds to me like the admin person you asked to begin with was probably ill informed.

P.S. I had a criminal conviction (petty theft) from 1981, when I applied to become a US citizen in 2004 & it concerned me. But I was open & honest about it let the INS do whatever they had to - in the end it meant a 5-minute talk during the interview, that was all.

yes and no yes you could be upset that they lied to you about how many years they were checking but it also depends on what the headquarters decided how many years to go back and besides you should have come clean to start with about your past
