My friend is being made redundant, she has work for the company for 10 years and is 54 yrs old. What is her entiltlement. The company is saying that it is not their fault they are going out of business, and are unsure that they have to pay anything.

for every full year after the age of 41 you are given 1.5 weeks pay....there is a maximum amount that can be paid and the details can be found at http://www.hmrc.gov.uk/manuals/eimanual/EIM13760.htm good luck
your accrued holiday pay should also be paid.

You do not state in your question which country you are in. This will make a big difference to the answer. If you are in the UK, check out the DTI website. This gives full details of what an employee can expect in these circumstances. I belive that it is 1 week for each year worked from the age 18 upwards and 1.5 weeks pay for each year worked from age 41 upwards. There is however a maximum amount that your employer can get away with paying which may not be anywhere near your actual full weekly wage.

There is a statutory minimum, but it's not much. Something like 1 week for every year worked. Some companies pay more than this.

If the company is declaring bankrupsy or something similar and therefore declares itself broke, then your friend may have problems claiming even this much, but I'm sure a local Citizens Advice Bureau would be able to advise. Good luck to her.

My chap got made redundant in January this year and he got 1 week for every year he had been there, plus any holiday he was owed and the company rounded up the figure witha bit extra on top. They don't have to do this, its their discretion. But it usually a week for every year you have been there.
