My husband owns the home we live in. He is currently paying child support every month.I want to file for myself.

I'm sure bankruptcy is different from state to state. I don't think you can file on child support though.

Child support doesn't enter into bankruptcy. There are certain things that you are allowed to keep even if you file together. The house, one car, things like that.

You can file and not him. but he could also but child support won't be on it, nor would the house.
