Copyright is different for that stuff

2006-09-22 07:13:53 · answer #1 · answered by Phyl 2 · 0 0

Copyright protects specific artistic works. So, if the words were part of a particular visual arts picture, then that could be copyrighted.

More likely, the issue would involve trademarks, which protect certain words and phrases as they relate to commercial activities.

The phrase "Roll Tide" by itself may be considered generic and thus unprotectable if you are talking about some oceanic or surfing description of wave conditions. But if you some used the phrase to describe a hair spray or a type of candy, that might be protectable. Trademark law can get fairly complicated, because it has both state and federal components.

Many colleges have licensed their names, slogans, mascots, and logos. You might be in violation of copyright law....but unless you're printing a lot of t-shirts with the intent to sell them for profit.... you aren't going to make a big enough dent for them to bother filing lawsuits against you. But if they do.... I think you're toast.

The way colleges are trademarking phrases or mottos, you'd best check to make certain that you are in the clear on that.

It's cool as long as you are not selling the shirts. If you sell them then it could be a possible infringement.
