Hmmm Laws are different in every State. So you need to contact your atty and find out what youre rights are. Where I live, no matter whos the house is before or after a marriage, once married everything is divided 50-50. The only other way you could get him to leave is if hes abusive. Then he can be forced out. Ask your atty. Whatever you do don't throw his stuff out until you legally have the right to do so. OK.. Lay low and keep bugging your attorney for his advice on what to do. If your husband won't leave n you are absolutely sure its over, move into another room in your house. Like a spare bedroom, and put a lock on it, don't cook for him, don't do his laundry, don't do anything for him and he will get the hint. He will want to leave maybe after seeing you mean business. Wish ya luck.. Let me know how things turn out.. :)

you'll more advantageous acceptable see a criminal specialist. in case you probably did not understand, Nevada is a "community belongings" state. meaning some thing obtained by making use of both better 1/2 in the course of the marriage, such as earnings, belongs to both spouses both. You likely won't be able to do some thing about your earnings till you divorce; as long as you're married, your earnings are community belongings. As some different person already stated, you do not desire your spouse's permission to interrupt up. in case you want a divorce, then document the right place of work artwork, and serve her with the summons and criticism. it truly is all there is to it. See a criminal specialist. i'm no longer confident about Nevada, yet in California (yet another community belongings state) the "community" is dissolved in the hot day the spouses separate with out reason to proceed to be married. At that aspect, earnings change into separate belongings. yet which could no longer be the rule of thumb in Nevada, it truly is why you want to work out a Nevada divorce criminal specialist.

The answer to this depends on the state, length of marriage, who filed for divorce, cause, dependents involved, and so on. In some community property states, for example, the house may be just as much his as yours in certain circumstances. There may also be some protections for him under the legal domicile laws. In other words, you should be careful about being too confrontational in all this.
By the way, before listening to some of the others here, you should also think very carefully before making false charges of abuse. If the courts finds out, you may be liable in both criminal and civil courts.

If the lawyer is sure you can't get him out, just live your life like he's not there til he gets the hint (hopefully) or you can toss him with the papers in one hand and YOUR door handle in the other.
If his stubbornness was evident before you got married, you should've known he was gonna behave this way. But if he's acting like this just now, let him know by your actions "I can show you better than I can tell you".
Hope this helps! Good Luck! And call me if you have a "My divorce is final and I kicked his *** to the curb-party"!!

He is in denial. I am sure he thinks you are just in a "mood". And it will all pass....and maybe it will. But if you are serious about him moving out. Pack his things, find him a place and tell him to go. If he choses not to...well then you have little choice. Your lawyer is right. He is entitled to stay untill the divorce is final. Or better yet...find him a new girlfriend! If she is hot and sexy he will run out the door.

Not sure that this is true, but I've heard that by leaving the house (moving out) he's essentially giving up the house or any claim to the house. Maybe he's received the same advice and wants to fight for it or for part of it? Just a guess.

I really think you should talk to the police, about having him removed. He is sick in the head if he still won't leave and thinks everything is OK after you have told him you don't love him and you have filed for divorce.. Good luck

You wanted out - so why not leave. The divorce will settle any property rights issues. Oh I get it...you want your cake and eat it too. He has been helping with the mortgage payments right? Is it really still ALL yours? Hope you had a cohabitation agreement and prenup.

Make it so uncomfortable, he wants to leave! Yell and scream at him when hes there. Change the house around, get rid of furniture. Have cable shut off, gas and anything else it takes. I don't know why you can't give him 30 days notice to get out if it was your house to start with!!

Legally you cannot make him leave. You will either have to learn to live with him, or move out.
Also, I don't know what state you live in, but make sure to ask your lawyer whether you meet any separation requirements even though you still live together.
