In the state of NC I was falsely accused 2x for communicating threats, the cases were dismissed. I am a professional and have no criminal record and although I have not been convicted of a crime my face is plastered on the charmeck website for all to see. Even though it is noted that no one should be denied employment or housing for an arrest record, people do it any way because this diminishes your character. yeah yeah you can get one of them expunged for an outrageous fee, but why? I think it is a violation of my constituional rights and my face and name should be removed from their database. also if you report something that you now know is not true is it not defamation of character?

Four Amendments primarily deal with privacy issues.

The 1st protects the privacy of membership lists for associations and groups. The 3rd protects private homes from being used to house troops. The 4th protects against unreasonable searches and seizures. The 5th and 14th also guarantee Due Process, which creates the Penumbra (umbrella, shadow) of other privacy rights.

What you are talking about is not privacy rights, or constitutional issues, unless the website is run by the government. It appears that domain is privately registered, so the constitution doesn't apply.

And it also sounds like they are reporting truthful information, that you were arrested. So, it's not a defamation issue. You may be able to sue them for public disclosure of private facts, which is a different tort and one that applies regardless of whether the info is true. But as with all such causes of action, the laws vary by state.

If you want to pursue this, you should contact an attorney in your state, and ask about suing for public disclosure of private facts.

I do not think people should know anyone privacy and being false accused is the problem of the police department they do not like people to call them I guess so I handle it myself. it called harrassment that just the way people are and you can't change the police or the public the best thing to do is ingrone them I know it hard I deal with this for having a epilepsy. What happens I report I was stalk and they tried to say I did commited a crime i was stalking him for reporting a crime. I also have the police harrassing me cause they believe I 16 so I always having them following me so I know how you feel.

Now you know what it's like to have your privacy violated. I am the girlfriend of a registered sex offender and that is my home's address up there on the internet for all to see with his picture.

Libel is falsely publishing something that is defamatory. Slander is saying something that is defamatory and falsely made.

It sounds like North Carolina is getting to be awfully fascist, somewhat like CaliforniMF

I would hire and attorney, pay the outrageous fee and go after whoever made the false accusation.

Well the 9th amendment says you have the right to privacy unless their is a government compelling interest then no you dont have a right to privacy. Defamation of character is when someone trashes your reputation. It doesnt sound like you have had yoru reputation ruined. Maybe you should to the people of the charmeck website and talk to them about it.

Whether or not a crime has been committed, our wonderful government invades our privacy all of the time. If they want to listen on your telphone conversations, they can and will without your knowledge. They can spy on us at any given time without our knowledge, but they can't find Osama Bin Laden.........go figure. So much for the land of the free or democracy.

I honestly do not know what constitutional rights we have left, but if I were you, I would make an appointment for consultation with a lawyer specializing in civil law.
