The law in California says that anyone caught driving a car unlicensed and uninsured while committing an infraction, gets a ticket and their car is impounded for 30 days. When they are involved in a collision and its reported to the police they get filed on for those charges on the report and get their car impounded. They don't go to jail or anything unless they run away from the scene and are caught. Your insurance Co. may pay for the damages to your car if you can prove that the other party had no insurance. The best bet is to hire an attorney and sue your own insurance otherwise you're SOL. Sorry.

Same thing happened to my husband last year. He was hit by a woman with no insurance and no license...although she did have a passport to show the police officer! Same scenario, she called her boyfriend on a cellphone, they pleaded with my husband not to call the police, that they would pay cash. There was just too much damage done to his car to consider that. Luckily, we had uninsured motorist coverage and our insurance did end up paying for everything.

We heard that our insurance company went after her and she disappeared. She couldn't be reached by phone, mail. They figured that she left the country. We were told that the DMV has her info and that she won't be able to apply for a license (not that she would) without having to pay back our insurance company first.

This is one of the reasons why auto insurance is so expensive! Try turning in your claim...your insurance won't go up and it won't show up negatively on your driving record. Look on your policy to see if you have UMPD or UM coverage.
Good luck...and surprise, we live in LA too.

This guy is breaking the regulation, and you're helping him. criminal action would be confusing provided that there grew to become into no longer a record filed on the time of the twist of destiny. i'd propose calling your coverage enterprise to verify what they say. i'm particular they have dealt with this form of ingredient formerly. it incredibly is why your costs are greater to conceal uninsured motorists. yet your coverage could have the journey and criminal backing to verify if going after this guy is incredibly worth it.

I think you're SOL. this is the price we, the consumer, pays in order to have low cost labor in this courntry to work at hotels, restaurants, construction, Walmart, etc., so that businesses can continue to make money. The businesses do not need to provide any insurance or benefits for these illegal aliens since they have no rights to stay in this country, and hence have no rights as employees in this country, either. And due to the incredible number of $40 / week south of the border employees looking to make $80 / day here in this country, there will be a bunch of illegal applicants for every illegal who is no longer scheduled to work at their current job.

You are screwed your insurance will cover to the limits but you will get nothing from the illegal.
You could try to sue but will get nothing if you win.
the illegal will just jump back across the border and comeback a few days later with a new name and id cards.
I feel for you I am here in AZ and have to deal with the same crap eveyday.

since he is an illegal immigrant they will probably make you buy him his own car so that he won't have to steal.
