buyer the right to enter your property to care for the tree
OR you dont mind person digging out the tree and having a dirt patch in your yard for awhile??

That's pretty funny.
Are you selling it for stumpage? Is the buyer going to cut it down?
Are you selling the live tree? Will it survive transplanting?
Why would you want to, anyway? What will removing it do to your property values?
If it's yours, you can do what you like...but I sure would have liked to see more details!
