I need to know if my sons can contest my will. They are all over 21.

Anyone can try to contest it, make sure you do it with a good lawyer that shows that you are of clear mind and they should not be able to change anything in your will. Make sure to document everything as you are making the will as to your staus of mind.

Anyone can contest a will. It becomes a matter of justifying their action and what interest they would have in the estate. In the state of NY, only a spouse has a "right" to a part of the estate. I believe it is 1/3 in the state of NY. You can exclude one or more children, but if they or their attorney believes they have grounds for legal action, they may pursue it.

Yes, a family member can contest it - that doesn't mean they'll win, but does mean legal fees for the contestor and for the estate. Talk this over with the attorney making the will.

If you are leaving one of your sons out of your will, there should be a line that says something like "I intentionally make no provision for my son _____" so nobody can say later that his omission was an accident.

they can but hard to do. Will cost them a lot of leagal fees
