In my state, you have to have something showing that he has other coverage first. Or that you are divorced. He refuses to get any. I am thinking of changing jobs just so that I don't have to cover him anymore. In this state you can't file for separation and if it is contested, you have to wait two and one-half years for the divorce to go through. Why should I cover a a philanderer who moved out on his wife and kids?

This is a weird state. It was to protect wives from husbands dropping them after running off. It is backfiring in my case.

Double check the specific wording of the state law you're referring to. It sounds quite a bit unrealistic the way you've described. More than likely it will state that you just have to have started the paperwork for a legal separation or divorce, and then you can drop him from you insurance. In general concerning divorce/separation, once you file the paperwork, you are protected against anything economically your spouse does from that point forward. Therefore, I will bet your state law will allow you to drop him from your insurance once you start the paperwork.

I am not the best person to ask but I will give my advise. My husband is an adulterer too. So get the new job if it works for you, but think about what you will loose in benifits before hand. Vacation time, sick leave or anything else. Talk to the insurance rep and see what they can do. Up the child support to cover his insurance cost plus a bonus for you. Hope this helps.

Leave that shitty state! I can't believe how fast the USA is going down the toilet. It's because we have morons in the federal government and more morons at state level government who are hypocritical religious fanatics.
If I were you, I would change my bank account and simply not pay a penny for the cheating bastard. Then move to a different state. They can't do anything once you move. Oh, try to move to a state which is not run by Christian conservative morons.
States to avoid at all costs: Texas, Alabama - bible belt in general.
Desirable states: New England.
Rip-off states: California, Oregon, Washington

Depends take into consideration will the new job pay as well have as good benefits and will you be happy there... If the answer to all of this is yes then change jobs if any of them is no all i can say is tough it out even though your pissed off you do not want to make a move that is to your and your children's disadvantage... first of all, as his legal wife, you can be billed for any medical services he may need so file for the divorce and continue his coverage while you are still married, this protects YOU. ... by the same token, you are also entitled to carry life insurance on him in case of his untimely demise. the cost to you is minimal for this and is in your best interests to protect you from the expense of a catastrophic illness while you are still his spouse.

Absolutely don't cover him! My job did not ask me if my x had insurance. All i needed was my divorce decree to get him off my insurance.
