employer wants his employees to live on an Iraqi soldier base without proper security or hardened shelters. We currently live in a hardened bldg on the U.S. side of the base. Is he liable because he made us live in an unprotected base if a mortar or bomber comes in our living area.

The work is inherently dangerous and you are, no doubt, compensated accordingly. Check your contract and see an attorney.

Any contractor that has people in Iraq has probably had them sign a waiver. The people know that they are going into a hazardous area, and they know the risks and get higher pay for taking those risks by being there. All that the contractor is responsible for is getting the job done on schedule. However, if he was "negligent" in legal terms, then you might still have a case. Proving negligence however, in a war-torn area, might not be easy to do.

Read your contract and read it well. They are supposed to supply you with some kind of security but that all depends on location and threat assesment. IF you feel at risk put it in writing and if he fails to acknowledge your concerns then you have the right to pack up and leave and or sue the **** out of him.

Usually people who take on these kind of jobs have to sign a waiver knowing that there is an amount of assumed risk.
