My daughter has gone to see her father over the course of three weeks on her regular visitations wiht him. He is 37, lives with his mom. The house is completely filthy, smells, there is dog poop and pee in the floor of the kitchen, trash everywhere, throw up stains everywhere, the room that is supposed to be my daughters is trashed wiht their stuff stacked up in it, no room to walk, her sheets are never washed, she bascially doesn't even have a room. They only buy fast food and don't have regular meal times (which leaves my daughter starving sometimes), they don't make her brush her teeth (she is 12 and should do it on her own but she is the type of child that needs reminding), she can't take a bath when she is there because of the filth. Recently, her cousin, 16yrs and a known drug addict has been come over there when it is her visitation with her dad. They let this girls boyfriend, 17yrs and a known drug user, sleep over while she is there. What can I do legally? Anything?

yes, legally, go to your lawyer, tell him you want to modify your custody order. You can file an emergency or routine motion. It'll cost a few hundred dollars, and it'll take about a month or less with emergency and 2 months or so with routine depending on the court case load. You'll have a mediation at which you'll discuss your concerns. He'll have a chance to defend himself and they'll probably give him another chance to clean up, etc. If he can't do better within 30 days, have your attorney file for a custody HEARING, be sure to file within 30 days or you'll have to go through another mediation. In the mean time, call Children and Youth, ask them to go over and inspect. They will make a visitation and make sure you know what their findings were. Keep records for court.

Yes! And you need to! Your daughter is going to be exposed to something (not that she may not have already) horrible if you don't . Does she want to go over there, or do you have to make her? You need to speak with your divorce attorney, or whomever handled the visitation, and advise him/her of your concerns. This is not acceptable. A judge can sign papers drawn up by your attorney that put provisions IN PLACE for her safety. I wish you luck~

I wouldn't normally advise this, but you should contact Child Protective Services. And you should contact your court system to see if you can get visitation stopped until he cleans up his act.
It can be done, but I'm not 100% sure how. CPS is a good first step in that situation.

You can take him to court, and ask a judge to change his visitation rights. The judge can order that he only be allowed supervised visits with your daughter at your home, until he improves his living situation.

well you can get legal advice .. i don tknow what your situation is but even if a judge has given your other half permission to see your child it can be reassessed. You can get social services involved its aserious issue. and you need to act quickly before your child gets influenced by it. get legal advice..

he is an unfit father talk to your lawyer and not allow visitations untill he is moved on his own.
