In some states, like Missouri, the official gender defines. If your main mechanical fitting is male, you go to the men's room, and if your main mechanical fitting is female, you go to the ladies' room.
In some states, if you are dressed appropriately, have a letter from the shrink that says that you are undergoing change therapy, and behave appropriately, you go to the restroom of your assumed gender.
Last halloween, to tease the women folk at my work place, I wore a dress. The only other dress in the office was of a woman dresses as a witch. I was getting a bit nervous, because until I spoke I was passing as female half the time and by the time I needed to go to the restroom it was going to be a concern. I wasn't 'assuming a female role' nor did I have some doctor's note, so I wasn't at all interested in the ladies' room, that would have been completely inappropriate. Fortunately, the men's room was empty while I was there, imagine if some guy had walked in and saw someone with long, blonde hair (cheap wig), hose and heels (not too tall), but with a dress hiked up to do the business at a urinal--it might be a problem.
I hear that the trans folk scout out the unisex restrooms and use them whenever possible. Fortunately, in some cases, if the respective gendered restrooms are those small, single user facilities, then one can go for the room that fits the attire. The real problem arises when men are doing what they are doing expecting only men about them and women are doing what they are doing expecting only women about them, but someone doesn't fit, that inappropriate person could be doing something criminal just by being there, in some places.

My spouse is an FTM. If you are passing (that is - seen as the gender you want to become) then you use the bathroom of what you want to become. If you are in no way passing than you use the bathroom of your birth gender. If you are at an in-between stage it is safer to use the women's room - because most women will not have a physically violent reaction to your being there. That is, if you don't have any other options available. Other options are: Single stall bathrooms - you may use either because you will be the only one in there, having someone with you to check if the restroom is empty, or holding it until you can get home. Holding it had caused my spouse 3 Urinary Tract Infections so far - so it's not advised. We generally try to travel in a "known" area - if we go out for the day, we know where our friends work and who will let us use their bathroom, we also try to make sure that we stay within reasonable travel distances of friends/families homes - so that we can stop in to use theirs. There are solutions, the biggest worry is other people's reactions.... my spouse does not worry to much because I am there to defend, shield from view, and tell someone to mind their own business.

Now now now...we know we're being naughty aren't we *wink*. personally, especially since I started going through menopause, will use which ever bathrom is empty at the moment, the men's included. If it's got a seat, I'm using it. I suppose, to answer your original question, it would all depend on the mind-set of the Transvestite. I've seen some who choose to use their original sex and others who use the one they are "now". I suppose it all depends on what one is most comfortable with. Blessings.

Transvestite : Probably the most touchy of the two ..
but I guess you better lpay with it and go to the ladies room..
Transexual : since they pretty much got their parts changed .. they go to whatever sex they are now..

I guess it would depend on what gender they identify as.
A Female to Male transgender, should be able to use the Men's restroom and a Male to Female should be able to use a women's restroom.
I personally have no problem with this. It's in how they idenitify, if they're comfortable enough to walk into the women's restroom, I'm perfectly comfortable letting them.
But then again, women's restrooms have stalls with doors that actually close, so it's no sweat off my brow.

To whichever is appropriate to the way they are dressed. It would be disconcerting to find a MTF dressed as a woman in the mens room; and just as disconcerting for women if the situation were reversed.
