My 360 freezes up every now and then while I play Oblivion, but besides that it hasn't given me any problems. You should probably call/email customer support.

No, but since this happens to you and some others, get one of the CD repair devices where you crank up until the scratches are gone. To keep the discs further protected, get Dskin labels.

if ur 360 is put up right dont touch it when there is a disc inside cos it will scratch it.

nope,thats not normal -
take the XBOX back and ask for a repair/a new one - you do have the Guarantee card.
