I need the advice of a family law attorney or maybe even a knowledgable para legal. my grandson has pretty much been raised by my husband and I,my son was given primary custody of him by a judge. Last year the mother finally went to court and the judge said by law she had to let her have half custody of him. My grandson would scream and hold onto the door jams to keep from going with her,it would tear our hearts out,& anyone watching, to see him go through this.My son, a couple of month ago went to prison!The baby's mother goes through guys like crazy,the baby has already seen her with i don't know how many different guys. Well, she has a new one and he lives in New Jersey.The judge told both of them they could not leave the state,but she has snuck off with my grandson to new york.My son has the legal right to file parental kidnapping on her but he's not here.What can i do to get him back here.I know he's got to be upset cuz he always wants to be with grandma,but mom just doesn't care,

Get Social Services involved. If the mother is endangering the child by exposing him to a parade of strange men and endless moving about, there's a fair chance of your being awarded temporary custody.

I am not an attorney or a para legal.

In my case I have joint custody of my son. I have physical. I can not move out of state without the permission of my ex. I am not sure if I can even leave state without his permission. We get along and if I wanted to take my son out of state for vacation it would not be a problem. Now if I moved out of state my ex would have a big problem with that and has the right to call the police on me.

Ok now back to your issue here. Your son has custody but so does the woman and your son is in prison right now. If the girl left state and she isn't suposed to then she broke the law. Your first step is to call the police and see if you can press charges, although I don't think the police is going to looking for the kid.

If that doesn't work then call a lawyer and ask if you guys can do something at your end, or can your do something at his end. You may have to get some paper work and send it to your son.

If you have a way of contacting the mother (address, phone) then maybe the lawyer can send a threaten letter to bring that child back.

Once that child is back perhaps you can take her to court and fight for custody yourselfs. I am sure you son wouldn't mind you guys having custody as long as he got to particpate in the childs life and if it keeps the child away from this unstable mother who sounds like she moves from one guys house to another.

I am sure you can get a question answered by a lawyer for free and then any further steps you take will cost some money.

Hmmm. While your son is incarcerated the custody of the boy would go to the mother. If you as the Grandparents want to file for temporary custody of the child until your son gets released, then you MUST do so immediately. contact an atty.

go to corut! can you prove that she is unfit? if so you can get custody of him. You just have to prove to the court.
