You should have been assertive in the possesion of your son. Thesedays I find sentiments are on the slide. Seek possesion of your son. But if you do not have any attachment or sentiments for him, let your husband have the child. Since it is your wish to have divorce, decide before hand so that it is not unconfortable before others

If you are mother irrespective of the capablity the chiled will be in your custody till he matures. On the otherhand you cant stop your husband meeting your son legally.
Generally this is a standard practice adopted in Inidan Court of Law. If you want him to let to your husband volenteerly then the son can stay with his father.

The family courts side with the mother most of the times unless she is a user/pusher or is a criminal where in the father can convince the court to give the custody to him.
It is better to have a joint cutody but even better ifor the kid f you guys can work your problems out and stay together.

it will depend on the court. If you both are fit parents he will stay with each of you part time. It is usually best for the child although it may be rough on you and make you feel in a desperate condition. Do not take him and run away or they could give him to his father full time.

if your a mom,the son will be yours.......but it dpends upon the capacity lto provide the needs of your son...if you dont have work at all,it might your son will be in the custody of your x partner.....
