ok in USA. and we havent slipt yet I plan on leaving him and taking the kids but if i dont have a job could i get child support?

File a petition in Juv. courts then you can have it automatically deducted from his pay check. Unfourtuanatly, if his name isn't on birth certificate, you must get a dna test. I have gotten an allotment (child support) check on the first of the month like this for the last 18 years (and I still have 2 more years to recieve it), he doesn't even touch the money. Along with that, your child/children should get medical insurance. The military does NOT play around when it comes to them paying/not paying their child support. The first thing you must do depending on your state if you were never married to the service member is establish the parent child relationship through a paternity test and usually department of childrens services or the attorney generals office will do this if he's proven to be the childs bio. father then a child support case will be opened and he will get served with the info concerning the hearing date if the two of you cannot agree on an amount then the judge will do it based on his income provided he isn't deployed overseas and provided he is able to do the dna test if hes overseas the hearing will be delayed until he returns unless he hires an attorney,so the first thing that has to be done is establish the paternity of the child and as I said go from there if he's proven not to be the father then no further action will be taken I'm sure you knew this but just thought I would throw that in there but you must remember that if you were never married unless you have a court order for child support the military cannot help you,you must have a court order if you have a court order it can be submitted to DFAS and the support will automatically come out of his pay even before he recieves it.

If your in Australia.....contact the child support Agency and they will take it from there and you wont need to worry. If there are any dramas, they will put an attatchment to his wages, also you will get his tax refund if he has a debt of child support that is owing to you and the kids. I dont know what the red tape is for other countries...........

The divorce atty. will include it in part of the settlement. If he doesn't pay up then all you have to do is contact his squadron lst shirt or commander. Go to the Finance office and ask them about the necessary steps to garnishing his wages or getting an allotment started.
