I live in Northern Texas. My wife and I are swingers and have just bought a home here. We have been harassed twice now by the local police. The first time was because we had our friend park in a public park after hours. When one of the guest said the he gave some money for food they lockup my wife and I up and would not give her her medication. We were not even read our rights. When we had them park on the street. The patrol officer admitted he did not care about the parties but his commanding officer told him that he and another unit had to come and ticket any car on the street that was violating the trafic law. Because we were throughing a swingers party and his officer fif not want that stuff going on. This was 11:35 pm. and only my street to a certain point. What course of action is available to me to fight this type of discrimination.

Sounds like the problem was that you guys weren't staying IN the house to do your carousing. If you are taking your partying to a park after closing hours, then yes they can arrest you. Based on how articulate you are, they may have read you your rights but you were too busy cussing them out to hear. You maybe wanting to give the police grief over your treatment, but I suspect the neighbors are cheering them on. If you kept your little party inside and with the shades down, and guests properly parked, I doubt that there would have been any police bothering you.

I think the (weak) basis that they are charging you on is that at least one of the guests paid you money - albeit for food - and there was sex going on. So an ill-informed person could argue that this person paid money for sex.

Nearly the exact same thing happened at a party I was at in the early 1990s in a different state, with the same argument being raised, plus a felony charge from one of the sex toys they found. Eventually all the charges were dropped, since it was obvious to any sane person that this was not "sex for hire," but not after it cost the hosts a lot of money in legal fees. It was basically harassment or discrimination by the police, which is what it sounds like your case is as well. Suggest to your attorney to pursue this particular area.

Hmmm.. you are in TEXAS. That should tell you right there. I'd move to a less bigotted state. But an attorney could give you some good legal advice. Maybe the police officer was miffed because he wasn't invited.. send him an invitation next time.. ;-)

if you go to court and tell them what you told us, they will dismiss your statements on account of being foggy and confusing.. try to sort this thing out in your head first..
