I am training to become a nurse assistant and I am almost finish,I have 1 misdemeanor from 7 years ago. Would this keep me from getting a job?

Probably not:
a) You are in a high demand field.
b) The nature of the misdeanor might affect as would the sentence.
c) The time since the indicdent.
d) Your honesty on the interview/application. If you skip over it - you're history when they run a police report.

My er, "hickup" was in 1997. However, it was a felony (drug related). I was 19 and stupid. till this day I can not get a decent job. I know a person who has a good position with one of Florida's number one employer. I know that most companies use outside companies for the sole purpose of checking backgrounds. It's my understanding that there are different levels of background checks. A person applying for a state job gets a more thorough search than, lets say, a person that wants to sell vehicles. It's a matter of what an employer is willing to pay. In years past the background check went back 5-7 years and looked for felonies. However, now some companies are doing thorough searches. i learned this because i applied for a job in cellular phone sales and my record from 97' came up. The company that did the background even sent me a letter and the "rap sheet" It seems I will always carry this scarlet letter. I grew up, paid my dues and over all believe myself a good person with a lot of wisdom. I never heard of someone getting a misdemeanor background check. Unless it's a state job or in education. Contact the U.S department of labor and see if they are willing to assist. Also, if this is his only record, call a lawyer about expunging or sealing this one time incident.

It depends on what the misdemeanor is for, and what kind of work you want to do. A private nursing home will probably have a looser standard than a large city hospital. If they are running a background check on you, it'll definitely be reported, so be honest when you're filling out the background check forms. They may or may not toss your application for a misdemeanor; they will definitely toss your application for lying.

Probably not, although the nature of the misdemeanor could be important if it is related to patent care, for instance. If they ask you about it, answer truthfully, emphasizing how much you have changed over the last 7 years.

As far as I know , companies that do criminal checks are primarily looking for felonies.

I am speaking to from the viewpoint of a convicted felon; 3rd Offense, DUI. When I was arrested and convicted of my first misdemeanor, I was sure my life and education were finished. In complete humility, I admit I was arrested 3 months later and spent the next 4 years in probation; and was discharged without incident. Yet, I managed to continue my education. Then, over 12 years later, I received a 3rd DUI conviction (felony). I am currently adjusting to the consecuences of my choices.

MY POINT IS... Learn now!!! Be thankful a misdeamor means something to you.

My advice to you would be to be honest with them, and tell them you have a misdemeanor, from 7 years ago, and that you just wanted to know if your waisting your time, with applying with them, because you have a "Paralegal" friend who told you that its considered "Discrimination" should you not higher me, for this small misdmr.. There aren't any companies that can legally turn you away, for anything, except if you pulled an "armed robbery" and was trying to become a Lawyer, then it wouldn't be legal.. I do have a friend that is a Paralegal, that pulled a house robbery, and did his time, and while he was in prison, he studied the laws, on this and got licensed to become a Paralegal, while in prison.. He now works for a Law firm.. Just explain you were young, and you learned your lesson.. And most company's wont discriminate,at all.. The only way you would know is if you were very qualified for the job, and their were no other people applying for the position.. and they still turned you down, thats when I would go to them personally and talk to them about the laws of this sort of thing.. And how its illegal for them to not higher you.. And pull a "Arin Brockovich" and get "Ballsy" with them!! Tell them you will be a Hard worker, and you will be reliable, and that you went to school just to better your life, and put the past behind you, for this very reason.. To get a good job, and start fresh!! I'd almost promise you they wont discriminate,and all your worries will have been for nothing.. I spoke to a Registered Nurse in our aptartment laundry room, and asked her all the same questions, because I'm in Medical school, myself, and have two misdemeanors out of another state, and she said they higher even "Felons" if they can explain what the arrest was for.. to the employer, so dont sweat the small stuff, you'll do just fine!! And Good-Luck, to you!! And Congratulations, on your New job!!! I'm going to pray for you, and believe God with you that you have already got the job!! Just believe it with your whole heart, with me, the bible says.. And dont go in there with a guilty conscience, because God's already wiped it from your slate, now you have to let it go, and believe God for this new job!!! smile!!

One cannot say for certain whether it would affect a job, but most background checks would typically uncover (in terms of legal actions) only felony convictions or dishonorable discharges from the military.

For most jobs...no, but if you're trying to get a government job, it might show up.

I think felonies only show up on background checks. And if it was 7 years ago it probably fell off your record by now.
