Hi everyone, There is somethign I really need to know.
If a man was married for like one year and he wants to get divorced, how much can his current wife ask from him ( money, posessions etc.....) Any help would be apreciated.

Peanut, I´m not HIS girlfriend, his my best friend´s husband, and she wants to know how much can she ask for, that was good advice though, but thank God I´m not in that pityfull situation.

Depends upon the state, and it's divorce laws. Generally she gets one-half the assets of the marriage ( property, cars, house, etc. obtained during the marriage). If he owned anything before marriage, he would have to prove ownership in order for it not the be included.
She may be entitled to alimony, and that would be set by the judge. Not all states allow alimony.
That would run until she remarried, or died, whichever came first.

Darlin', are you opening a can of worms!! I take it you are asking because you are the girlfriend? Wake up!! This guy has major commitment problems and you do NOT need that. Not only that, he doesn't have the decency to get out of his first marriage before he starts seriously playing around with you. NO!! How could you want to be called a "home-wrecker?" Since he won't do it, YOU do the right thing....walk away and do NOT talk to him again until he is divorced. He is a sneak and I'm hoping you will walk away.
Even if there are no children, in California, there is alimony. You can look up what the standard scale would be for his alimony payment in the California Family Law Statutes.
Keep in mind, this is money that will be paid for a good period of time and will come out of the money that should have gone into family expense money. What if you marry and have a child with him? You will always be strapped for money because of the alimony.
Again, WAKE UP and RUN, don't walk away from him.

Well, first of all lemme say I am sorry..I was married for a year and a half so I know what you are going through..but the best advice I can give you is to look up the laws of your state and check that out..usually its 50/50 but in some states its different..as far as the money goes, as long as you are still married to him ITS ALL HALF YOURS HONEY!!

I could go from half the increase of the family state during the time the marriage held up, to the plain half of the sum of both states or his state.
Any prenup agreement has much more weight than the law itself.

Half of the marital assets.
Your best bet is contact a lawyer. I've seen a few divorces in my day and unless the couple is splitting up in a way that is mutually gratifying, there MUST be a lawyer.

Different states have different laws so best to ask an attorney. If you cannot afford one, try to get one through Legal Aid. Your marriage was a short one so I dont think she will be able to get much. Still, better to be safe than sorry.

you can ask for half of everything,and if you signed an agreement,you can take alot more.good luck.
