a friend worked at a casino for 3 mos, was fired then worked for their race track & filled out another w-4. when it was time to file he only got one w-2 back from the casino & not the race track & he was pennalized for not reporting income. shouldn't the company get pennalized for not sending out the w-2's?

It is up to your friend to declare ALL income...even if he doesn't receive anything from the employer.

He should have looked at all his pay stubs from the race track and totalled the amount he made, and all the deductions, then included those amounts on his taxes.

He would have needed to type up a letter of explanation to the tax office to explain where the numbers came from and why he was doing it manually. Then it would have ONLY been the race track in trouble.

Yes and no. The company should be penalized if they did not send a W-2. Your friend knew he had worked at the track and should have known he did not have a W-2 for that job. It is his job to report the income.

Most probably. WHat the casino is doing is circumventing the law. Your friend was not at all fired but to do away with his work tenure they had to make it look as if he was an entirely new hiree everytime he worked for them. check your local courts for this type of case

It is up to your friend to make sure they had all the w-2's before filing his taxes. If he tried to get his w-2 and couldn't then that should have been reported. Your friend has to bite it on this one.

Your friend knew what his income was and it is his responsibility to report it. Even if his employer makes a mistake or fails to report it, that does not remove the responsibility your friend has.

It was your friends responsibility to obtain all his w-2's for the year, not the employers responsibility. They mail W-2s as a courtesy.

They should, but that's not how it works. It is the responsibility of the tax-payer to secure all documents required, and no excuses accepted.

I believe the company should be penalized...it is their responsibility to mail them out by the deadline in January.

Sorry, but your friend is at fault, I'm sorry to say. We all know what earnings we have, and whom we worked for........so in all fairness, the tax folks are correct this time.

well they should and its there responaliblety to send out w-2 forms and its the employers responality. you the employee its your responality to make sure you get it. that why I keep my last pay stub.
