My home was broken into in Nov 2005 and the only things stolen were my two parrots. These birds had been with me for over twenty years. The thieves have been identified and are going to trial in a month. I feel so helpless. I think I now understand why people bring guns into a courtroom. These 3 guys have taken my "babies" and will probably get a slap on the wrist. In the meantime they say one of the birds died within a month and won't tell the police anything on the whereabouts of the other bird. All I want is my bird back. What can I do? Ummm legally that is.

Talk to the District Attorney who will do the prosecution. Have him talk to the Defense Lawyer. Tell the DA your situation about the birds and he can ask for a more severe sentence if the birds (ask for both) are not returned. You can also ask for restitution of the value of the birds. If he does get out he will have to compensate you for your loss. You can also get with his probation officer while he is working and if he does not make reasonable payments toward your loss he can be sent to jail for failing to comply with the conditions of his probation. You can also ask the court to keep a reasonable distance from your home (up to a mile away at all times). You are not powerless and there are provisions in the law to help you, but you have to ask for them.

Unfortunately, they've probably sold the one that lived, which is why they won't disclose information - they don't want to get in more trouble from the client who bought the bird illegally.
I know it sucks, and I know it's painfull, but consider adopting another bird or pet when you're ready. It won't take their place, but it will let you remember the love of those two pets as long as you have and cherish it. Best of luck.

They probably sold it to a buddy for dope money. Appeal to the prosecuting attorney to help you out, let them know the sentimental value of your bird. You can sue them for the value of the bird, but my guess is that it won't help you feel any better and they probably don't have any resources to attach either.

i'm sorry, i don't really have an answer. i don't know the legal system. but i just had to write to you and share your sadness. i'm so sorry you're having to go through this horrible ordeal. it would have been bad enough having one of your "babies" pass away normally, but to have one die in a situation as nightmarish as this is tragic. Talk to the district attorney and appeal to them I think that is your only recourse at this point.
