Unless, of course, you are paying for a subscription service and have agreed to a document saying that this is the case, then that is most certainly pirating music and you could GO TO JAIL. As a general rule, the government only bothers people who do this on a large-scale basis though. Say you have thousands of songs that you have downloaded and are now sharing with the rest of the internet, therefore promoting more pirating...there's a good chance they might come get you if they want to make an example out of you. Every so often they will do this. I would suggest that you unshare everything that you download so others cannot download off you. Also make sure that the program didn't automatically pick up any files that you already had on your computer and make sure they are not being shared with the community. Good luck pirating!!!

It is because, if the album hasn't been released yet, and it's on this program, it means someone leaked the tracks from the album to the Internet. And, Bear Share, like most P2P (Peer to Peer) software, has no way to control licensing, etc. So, if you are downloading any licensed file from Bear Share, you are technically breaking licensing and copyright agreements.
You can look up more information about P2P downloading and the legal controversies/ramifications at Wikipedia

Unless Evanescence released those songs for free, then yes, what you are doing is illegal. I can understand wanting to hear the album as soon as possible though, so I see why you would do it anyway. I hope you will buy the album when it comes out though.

Technically, yea it is. If your not paying for it or own the copyrights. But everyone uses Bearshare and Limewire so it's not really that big of a deal. For me, I use torrent files. So much easier and you can get entire albums.

Yes, it is illegal. It would be worse though if you made copies and tried to sell them.
