The tranny will whine for two reasons. One: the filter is just about stopped up and works the pump harder causing it to whine. Two: The pump itself is going bad. You say you notice some oil on your driveway, then maybe its leaked enough to where its low now. Run the vehicle until its hot, park on level ground, check the fluid with the engine running. Check It many times to insure a correct reading. The stick may not say full or cold on the scale, but have two marks. One for cold and one for hot. Since fluid expands as it heats up you only get the correct reading when it is good and hot! Like after you have driven it for a while. One other thing is the filter can come out of the valve body causing it to suck air into the pump. This might also be the culprit. If you have the owners manual, it explains in detail about how to check the fluid level. Use a Dexron/Mercon lll type fluid in it. Good Luck!

If it's a 5 speed and your sure the whining noise is coming from the tranny, And your not having any clutch problems it is more than likely the throw out bearing. They don't always get replaced when the clutch is replaced. or it may not be the tranny. If it does it at a certain rpm it might be an exhaust cover plate vibrating.
If you can produce the same sound in neutral at 3000 rpm then get someone to rev the engine and listen for the sound and try to pinpoint it. You may be able to just bent the cover away from whatever it's vibrating on.

First thing, how do you know the sound is your tranny?
Update:before thinking about replacing the trans, I would have maintenance done on it. A manual trans in a low torque car like yours can last a very long time.
It doesn't sound like a clutch problem, but that doesn't mean there isn't a tranny problem.

If its a wining sound that changes with the engine RPM when the car shifts it could be a bad tranny pump or it could be some thing rubbing on one of your accessory belts but if its a constant sound than it could just be some thing rubbing on a universal joint.

the gear selector only controls a cable to the trans, there is not any fluid to it directly. you could have a number of different leaks. oil, trans, power steering, coolant, even brake fluid for that matter. id double check the oil level first to make sure that it is still in the cross hatches on the stick, then go back to where you had the oil change done and see if they can not look at the car to determine where the leak is from.
