The women almost always end up with custody of the children, even if the husband was better off.
If you ex wife is doing drugs or isn't taking care of the kids or anything, get a lawyer and tell him you want custody of the child. You can petition a judge for a hearing and they will determine if custody should change.
If your child says he is having problems with his mother also. Is the living environment bad or is her new spouse a bad person. There are many reasons you could get custody. But if everything is okay at your ex-wifes and your kid is doing good then you most likely won't get custody. There has to be a good reason for you to get custody or she has to give custody to you if she agrees.
I had a friend in the same situation and he got custody of his kid because the ex-wife got on drugs. He got a lawyer and a judge ruled that he should have custody because the mother was a bad influence. if the neighborhood is bad or anything in your sons life is bad you can use that to try to get custody.

why do you want to do that in the first place ,is the child in any danger? because unless the child is being abused or the other person is doing drugs or something extreme like that you can't do anything, you can call a lawyer but they will tell you the same thing because you have to prove the custodial parent un-fit and you have to have more then just suspicions ,if you are a male you are going to have even a tougher case because in court females usually get custody , because we are usually the PCP of the child and we have more rights to our children then males do since we carry them in our body that is just the way it is.

You should find a good lawyer and have the money to pay him or her. If your ex has legal custody, you will need to fight him for custody legally and have some good reasons as to why he should not have custody and you should.

Doing anything outside of the legal system could compromise your chances of ever getting custody back of your child (like, taking the kid, or harrassing your ex).

Sorry, buddy, you don't have much of a chance unless your ex is a druggie or abuses the child physically. A judge may listen to what your child wants depending on his or her age (12 is about average). Definitely not a man's world.

You have to be the ideal parent. Making good money, being successful, and married. Maybe not being married, but if you can prove to the judge that you are more financially stable, available for your child more, living in a safe environment than your x's qualifications, then I think you are a winner my friend!
