I'm trying to find which pieces of legislation allowed for or enabled the quick growth of private prisons. I can find legislation relating to the topic on the state level, but there is little I can find on the federal level.

the state prisons can be privately owned by being built and financed by a person or corporation on privately owned land. most federal jails are build on federal land and funded through the government

I am not sure there has to be any legistation to allow it, if the government issued bids according to proper contract rules, and a legal contract was developed , what would have to be developed. Many things are prvatized from janitorial work to mowing to secuirty at times.
