I am currently on workmans comp.my employer sent me a certified letter stating to report to work and their only giving me 6hrs a day 3 days a week not even enough to pay my insurance through them. I am still hurting every day. I don't mind going back if i can do something that doesn't injure my shoulder any more than it is. but I work out of town and this will take a lot of gas can I get unemployment for the rest of the hours?

the doctor put me on light duty at the beginning of my injury they said there was no light duty with my kind of work I'm a nursing assistant so there for I did not get to work now they are telling me I need to report to work on the 20th. but not even close to my hours i worked I really don't think my shoulder is even close to being better it still keeps me awake at night.i can't even put a plate away without hurting and they just did an mri last week after 5 weeks of being injured plus had me in physical therapy without knowing what the problem was.

If you are on worker's compensation, you cannot be forced to return to work until your doctor releases you and then the employer has to return you to your old job with the same number of hours. So if prior to the injury you were working 40 hours a week, he has to return you to that amount. But if you are only allowed to work a limited amount of time, you need to talk with your doctor. Employers cannot threaten to fire you while off on disability due to work related injury and cannot make you return if your doctor says that you are not to return to work.

They can not reduce your hours to less than they were before your injury. You need to call your worker's compensation representative AND you must file a written complaint with your boss. Keep several copies, one of which goes to your physician as well.

You cant get unemployment and workmans comp at the same time.
