If you are not comfortable with the terms, do not buy the house. you do not have to do anything. personally I would not, nor would I suggest to my clients to purchase a new home without a warranty, either from the builder or a home warranty company.

The terms are always negotiable. If the seller insists on making you sign an as-is form and you are worried about an undisclosed problem then you need to consider walking away.

You can negotiate in this market, as housing price continues to slump.
