If it's legal, can the recording, which is recorded without asking other party's permission, be used as evidence in civil case in court in Ontario, Canada? Thank you.

YES. It IS legal as long as one of the people in the conversation is aware it's being recorded. I used such a recording in small claims Court. It is legal and encouraged to get evidence that someone threatened you, owes you money, harrasses you etc. The woman that I taped was threatening me-I was told I could even hand it over to the cops and have her charged criminally. This evidence holds up!!
However, it is NOT legal to TAP into someone's phone line and tape them or listen in. That is still illegal in Ontario and all of Canada. This is not the US!!!

No, both parties have to be aware that the phone call is being recorded. The recording would get thrown out of court. That being said, a good lawyer will get that information out even if it is stricken from the record. I live in Ontario, btw...

No, it's not legal. This is Ontario, this is Canada, and even if Mr. Harper here is fond of licking Cowboy George's boots, here we still respect people. This is not GWB's US.
