Under normal circumstances, it is highly unlikely that a 12 year could rape an 18year old unless the 18year old is petite and and the 12 year old is humongous. Or perhaps the 18 year old is handicapped and can't defend herself.
If indeed the 12 year old boy raped the girl, then definitely, he is at fault.
However, if the 2 are both normal (body and mind appropriate to their their age), it is more likely that the girl seduced the boy.

The boy is the criminal . Unfortunately, because he is under age they'll just give him a light sentence or nothing as usual .
If he did it once he'll do it again . Hopefully he will meet the right person and get the heck beaten out off him . Even that probably won't cure him . The jails are full of pigs like him .

Although when it comes to perverted sexual crimes of this nature where one is violated, it would be the rapist.
In this scenario the boy would be the perpetrator.
However, some would point out that the victim (girl) lead him on or whatever, that she looked younger than her age, etc. Who knows for sure??
In any case either way, both are eligible for juvenile court. Even if it was consensual, they're both underaged. And that is wrong.

If it is rape the the rapist is at fault ... but if both parties are in agreement to it the the 18yr old is the rapist because the boy is under 16.
