And it cost over $300 to fix it. I later found out my father did it one night. He said he wasn't drinking but it was because we had gotten into a big argument a while back. I keyed up his car in return and now he wants to take me to court, what should I do?

If he sues you, you can always counterclaim against him in the same lawsuit for the damage he did to your car. This would save you time and money in bringing the claim for damages because your claim would become part of the same lawsuit.

The damage amounts are so low, you would probably end up in your jurisdicition's small claims court. Depending on your jurisdiction, you may or may not need an attorney to represent you. This is something you need to check out.

I think your best course of action is to tell your father that if he files suit against you that you will counterclaim for the damage that he did to your car. In the end, you'll both be paying for each other's cars. Explain that it is probably not something worth going to court over.

Don't admit that you did it. Plead the 5th and move on with your life. He keyed your car and that was wrong and now you have stooped to his level. What is he going to do? He is going to go to court and risk having to tell that he did that to your car and then really think that you will admit doing it to his afterwards. That is just crazy. Don't admit it in court or to a lawyer. Tell him to forget it and for you to forget it. You both made a mistake--a stupid one. If he does take you to court, he would be a fool. Remember your rights. He will look bad if he admits doing that to your car. Then your lawyer or you can say that he keyed his own car to make it look like you did it, which will sound even stupider. Just do not admit it in court or talk about it anymore to your father. He could try to tape record you.
I don't know why this happened, so be careful and try to talk to your dad about your all's relationship and not the car problem, after that has passed. Be a better person than that.

keying up his car in return was the stupid thing to do. basically you should have taken him to court then. But now, you're just as guilty as he is... so the way I see it, the both of you now have two options:

1) you can go to court, sue eachother up the yin-yang, hire lawyers, pay court costs and court fees, and end up hating eachother for the rest of your life with no real winner,

or 2) you can forgive eachother.

First, you and daddy need to friggin' GROW UP. Then both need to assess and pay for the damage to both vehicles JOINTLY. Then you need to find a place of your own and MOVE. You and daddy need some separate time to complete your move to responsible adulthood. Yeah, he should'a gotten there a long time ago - but that does not excuse your immature and stupid behavior. Two wrongs don't make one right, dude.

Wow......that's taking the father/son relationship to new levels. I would offer to pay to fix his car, then I think I would put some distance between you two for awhile.

might as well key your mother's car and get the whole family involved then you can all take each other to court and sue each other

oh my god your family should be banned from breeding.
you should go to court and deal with your stupidity you should have called the cops on your dad instead of keying his car.
